We are the primary legal advisor to a number of housing associations and have an in depth knowledge of the social housing sector, governing legislation and the Department for Social Development Guidelines for Housing Associations. We are also a member of the Northern Ireland Federation of Housing Associations Ejectment Solicitors’ Panel and have wide experience in ejectment proceedings in both County and High Court.
Our Governance Team has a lot of experience of the drafting of Rules for Housing Associations and other Industrial and Provident Societies in Northern Ireland. Partner, Jenny Ebbage, prepared the model rules used by housing associations in Northern Ireland. We have revised Rules to modernise them in the context of Northern Ireland charity law and can advise on the interpretation of the Rules and on the duties, liabilities and responsibilities of Committees of Management. We have particular experience and expertise in mergers, creation of new Housing Associations and group structures including trading subsidiaries for private development.
We have also assisted with the registration of Housing Associations with the Charity Commission for Northern Ireland including preparation of the public benefit statement and advice to the management committee/charity trustees.
