Also known as Probate this is the process undertaken whenever someone dies in order to deal with their assets (their estate) and distribute them according to their will or intestacy.
The executors of the estate are responsible for ensuring that this process is carried out properly. What is required to achieve this will depend on the size and nature of the estate. Sometimes assets are held jointly and so little needs to be done – this is often the case when the first of a couple passes away. In other occasions there are a wide range of assets to deal with – property, investments, farmland or business assets.
